IndiaHedgeFunds is a brand of Decade Alchemy Pvt Ltd., a distributor of portfolio management services and alternative investment funds registered with the Association of Portfolio Managers in India (APMI) under registration number APRN04329.

For the purposes of the Digital Personal Data Protection Act, 2023, Decade Alchemy Pvt Ltd. is the Data Fiduciary for the personal data described in this policy.

Information you give us

When you request a consultation through the Website, we collect:

• your name, phone or WhatsApp number and email address;
• whether you are a resident Indian or live overseas, and your country of residence if you tell us;
• the investable amount range and investor profile you select;
• the products you are interested in and your preferred time for a call; and
• anything you choose to write in the message field.

If you decide to invest through us, we and the product provider you choose will also need the information required for Know Your Customer (KYC) and account opening. This typically includes your PAN, proof of identity and address, date of birth, photograph and signature, bank and demat account details, income and net-worth information, investment experience, risk profile, nominee details and FATCA/CRS declarations.

Information collected automatically

Like most websites, the servers that host the Website record technical information such as your IP address, browser type and the pages you request. The Website also loads fonts from third-party providers, which receive your IP address when your browser requests those files.

Information from third parties

With your authorisation, we may receive information about you from KYC Registration Agencies and the Central KYC Records Registry, and from the portfolio managers, fund managers, custodians and depositories involved in your investments.

We use personal data only for the purposes for which it was given to us, namely to:

• respond to your enquiry and arrange the consultation you asked for;
• understand your circumstances and check your eligibility for particular products, including regulatory minimum investment amounts and residency requirements;
• help you complete KYC and onboarding with the product provider you choose;
• service your relationship with us, including periodic reviews and updates on your investments;
• send you information about our services where you have agreed to receive it;
• meet our legal and regulatory obligations, including KYC, anti-money-laundering, record-keeping and reporting requirements;
• detect and prevent fraud, impersonation and misuse of the Website; and
• maintain and improve the Website.

We process your personal data on the basis of the consent you give us — for example, when you tick the consent box on our consultation form — and, where the law allows, for legitimate uses such as complying with a legal obligation or processing information you have voluntarily provided for a specific purpose.

You may withdraw your consent at any time by writing to compliance@indiahedgefunds.com. Withdrawal does not affect processing carried out before it, and we may still need to retain certain records where the law requires us to. If you withdraw consent, we may be unable to continue providing some services to you.

We share personal data only where it is necessary for the purposes above, with:

• Product providers you choose — portfolio managers, AIF managers and their custodians, registrars and fund administrators — so that they can onboard and service you;
• KYC and market infrastructure bodies such as KYC Registration Agencies, the Central KYC Records Registry and depositories;
• Service providers who work on our behalf under contract, such as website hosting, customer-relationship, email, telephony and messaging providers;
• Professional advisers such as auditors and lawyers, under a duty of confidentiality;
• Regulators, courts and law-enforcement agencies where we are legally required or permitted to disclose information; and
• a successor entity, if our business is reorganised, merged or sold, subject to this policy.

We do not sell your personal data, and we do not share it with third parties for their own marketing.

When you request a consultation, you agree that we may contact you by phone, SMS, WhatsApp or email about that request. Messages sent over WhatsApp are also processed by WhatsApp in line with its own terms and privacy policy.

You can ask us to stop contacting you for anything other than your existing enquiry or investments at any time by replying to any message or writing to info@indiahedgefunds.com. We will continue to send service and regulatory communications that relate to investments you hold.

The Website uses Google Analytics to understand which pages visitors find useful, so that we can improve them. It is loaded only if you accept analytics cookies in the banner shown on your first visit. If you decline, no analytics cookies are set, no analytics script is loaded, and no data about your visit is sent to Google.

Where you accept, Google Analytics sets cookies that record pages viewed, approximate location (derived from your IP address), and general device and browser information. We use this in aggregate; we do not use it to identify you personally, and we do not use advertising or cross-site tracking cookies. Google processes this data as our service provider and may store it outside India, as described in the section on transfers.

You can change your mind at any time using the Cookie preferences link in the footer of any page, or by clearing this website’s data in your browser. Declining does not affect any part of the Website.

We use no advertising cookies and no other cross-site tracking technologies. Fonts are loaded from third-party providers, as described above.

We keep personal data only for as long as we need it for the purposes it was collected for, or for as long as the law requires.

• Enquiries that do not proceed: we keep consultation-request details for 24 months after our last contact with you, and then delete them.
• Clients: KYC, transaction and communication records are kept for the periods required under anti-money-laundering law and securities-market regulations, which can continue for several years after your relationship with us ends.

We use reasonable security safeguards to protect personal data against unauthorised access, loss or misuse. These include limiting access to people who need it, encrypting data in transit, and requiring our service providers to protect the data they handle for us.

No method of transmission or storage is completely secure. If a personal data breach occurs, we will notify the Data Protection Board of India and affected individuals as required by law.

Some of our service providers may store or process data outside India. Where that happens, we transfer personal data only as permitted under the Digital Personal Data Protection Act, 2023, and take reasonable steps to ensure it continues to be protected.

Subject to applicable law, you have the right to:

• obtain a summary of the personal data we hold about you and how we process it;
• have inaccurate or incomplete data corrected, completed or updated;
• have your data erased where it is no longer needed and we are not required to retain it;
• withdraw consent you have previously given;
• have your grievances about our handling of your data addressed; and
• nominate another person to exercise these rights on your behalf in the event of your death or incapacity.

To exercise any of these rights, email our Grievance Officer at compliance@indiahedgefunds.com with the subject line “Data request”. We may need to verify your identity before acting on your request, and we will respond within the time allowed by law.

Our services are intended for individuals aged 18 and over, and we do not knowingly collect personal data from children. Where a product permits investment on behalf of a minor, that investment is made through a parent or lawful guardian in accordance with the product provider’s requirements.

We may update this policy from time to time, for example to reflect changes in the law or in the way we operate. The “Last updated” date at the top shows when it was last revised. Where a change is material, we will take reasonable steps to let you know.
